Welcome to Virginia Proffer Solutions. In 2016, the Virginia Legislature adopted a new proffer law that has upended the way proffers are negotiated in Virginia. Localities are prohibited from accepting “unreasonable” proffers as defined by the law. As a result of the legislation and the US Supreme Court Koontz case, many jurisdictions are no longer even willing to discuss proffers with a developer. Consequently, residential rezonings have virtually stopped in many parts of the Commonwealth.
Virginia Proffer Solutions was created to solve these problems by providing unbiased impact analysis and the calculation of specific monetary proffer amounts that satisfy the new law.
